Antecedentes

Hidrocarburos el Bajío, S.A. DE C.V. En el expediente 5511/17-07-03-3-3-OT se impugnó la resolución que determinó un crédito fiscal por $2'355,489.06 por IEPS omitido, multas y recargos correspondiente al ejercicio fiscal 2013.

Estrategia Legal

Tras obtener sentencia que declaró la nulidad de la resolución, la autoridad fiscal emitió un oficio para llevar a cabo una revisión de gabinete. Se impugnó esta determinación argumentando que el plazo de 4 meses establecido en el artículo 57 de la LFPCA aplicaba tanto para iniciar como para concluir el nuevo procedimiento.

Resultado Obtenido

VICTORIA EN AMPARO: El Quinto Tribunal Colegiado concedió el amparo, determinando que el cumplimiento de la sentencia se rige por el artículo 57 de la LFPCA y no por el Código Fiscal Federal, por lo que la autoridad contaba con el plazo de cuatro meses para emitir una nueva resolución definitiva. Derivado de esta determinación, el crédito fiscal quedó sin efectos.
